Terms of Service
These terms are drafted for the LeadGuard.Pro AI call catcher service and the account dashboard used by service businesses.
This is a product-ready policy draft, not legal advice. Have counsel review it before production launch.
Agreement
These Terms of Service govern access to and use of LeadGuard.Pro, including the AI call catcher, dashboard, messaging tools, websites, APIs, and related services.
By using LeadGuard.Pro, you represent that you are authorized to bind the business using the service.
Service Description
LeadGuard.Pro provides one core service: an AI call catcher that can answer missed or forwarded calls, collect caller details, and/or text customers back after missed calls.
The service may include voice AI, SMS/MMS messaging, call transcripts, lead summaries, service knowledge, website scraping for setup, owner alerts, and integration settings.
Accounts and Access
You are responsible for maintaining accurate account information and protecting login credentials.
Google login may be offered as a sign-in option. You authorize LeadGuard.Pro to process authentication information needed to operate your account.
Customer Responsibilities
You are responsible for the accuracy of your business profile, knowledge base, service list, scripts, emergency rules, pricing content, and customer-facing messages.
You must comply with call recording, telemarketing, SMS/MMS, privacy, consumer protection, licensing, emergency response, and industry-specific laws that apply to your business.
You must not use LeadGuard.Pro for illegal, abusive, deceptive, harassing, spam, or high-risk emergency dispatch purposes.
AI Limitations
AI outputs may be incomplete, inaccurate, delayed, or inappropriate. You should review and configure scripts, knowledge, and escalation policies before using the service with real callers.
LeadGuard.Pro is not a substitute for emergency services, licensed professional judgment, or human review for high-risk calls.
The AI should not guarantee appointment availability, pricing, arrival times, diagnoses, or outcomes unless your approved configuration and integrations support that statement.
Communications and Consent
You authorize LeadGuard.Pro and its providers to place, receive, route, record if enabled, transcribe, and send communications as configured by your account.
You are responsible for obtaining and honoring required consent for call recording, automated messaging, SMS/MMS, and customer communications.
Website Scraping Setup Tool
The website scraper is intended to help populate your service catalog and knowledge base from websites you own, control, or are authorized to use for setup.
You are responsible for reviewing extracted information before using it in customer-facing AI responses.
Fees and Billing
LeadGuard.Pro Voice Backup is offered as a $299/month subscription unless a different price is shown at checkout or in a signed order.
Voice Backup includes up to 150 AI-answered calls or 750 AI voice minutes per billing month, whichever occurs first. Once the voice allowance is reached, live AI answering switches to fallback mode for the remainder of the billing period.
Fallback mode may include a recorded message, voicemail capture, SMS text-back, AI SMS intake, and contractor notifications. The lead capture system remains active, but live AI voice answering is paused until the allowance resets.
SMS fallback is included for normal business use and is subject to reasonable use, carrier rules, and anti-spam limits. LeadGuard.Pro may limit or suspend excessive, abusive, fraudulent, or spam-like usage.
Trials, renewal terms, cancellation rules, taxes, and payment processing details will be shown at checkout or in the account dashboard. Unless otherwise stated, fees are non-refundable except where required by law.
Acceptable Use
You may not reverse engineer, overload, abuse, interfere with, scrape beyond intended setup flows, or attempt unauthorized access to LeadGuard.Pro.
You may not upload unlawful content, sensitive data you are not authorized to process, malware, or content that violates third-party rights.
Suspension and Termination
We may suspend or terminate access if we believe your use creates legal, security, operational, payment, carrier, or platform risk.
You may cancel according to the cancellation flow available in the dashboard or billing portal.
Disclaimers
LeadGuard.Pro is provided as is and as available. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Limitation of Liability
To the maximum extent permitted by law, LeadGuard.Pro will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost calls, missed jobs, or business interruption.
Our aggregate liability for claims related to the service will not exceed the amounts paid by you for the service during the three months before the event giving rise to the claim, unless a different limit is required by law.
Changes
We may update these Terms from time to time. Continued use after updates means you accept the updated Terms.
